Based on the United Nations Charter, Common Declaration of Human Rights, European Convention for the Protection of Human Rights and Fundamental Freedoms, International Pact for Civil and Political Rights, with worry we are presenting to you the unacceptable violations of human rights in Albania, the grave situation of crimes on life and property, as well as the actions against the national integrity of Albanians. The serious examination of this situation in total opposition with the basic political and juridical charters of the modern civilization is a fundamental obligation of every public authority. It is an obligation of Albanian and International authorities, International Organizations and their political and juridical mechanisms.

From 17 years Albanians are going through crises, social stress and tragic events, through which no other European country went. The insecurity for life, extreme poverty, stress of violence of politics and media, the doubt for the future continue to stimulate the ruin of life values and an endless and painful emigration. The consequences of this situation are also the tragic violation within the family, suicides as well as the murders for revenge and blood feud. This situation has become a worry also for those members of international community that are leaded by benevolent feelings for the future of Albanian people. This elongated crisis, that is continuously generating crime, is caused by the political leaders and their clans with inheritance from the past, positioned since the beginning of pluralism in both sides of the Albanian politic. These clans are influenced by anti-Albanian lobbies that work against the people’s interests and our national integrity. The influence of these lobbies in the halls of Albanian politics realized the predomination during these years of the fight for power and anarchy; ruination of all our national affluence; the organization of unrests of 1997 for the collapse of the Army and state structures, steal of Albanians’ money and the incitement of population in the civil war, where 1500 persons were murdered. The anti-Albania lobbies with political and religious support in the region and broader have been and remain the main danger of the stability and progress in Albania. The Albanian governments, under the pressure of Europe for stability, cover this situation with media propaganda, sophisticated demagogy and phony debates on reforms and integration. Under the domination of these political leaders the democracy has been violated and deformed. Many draft-laws of the governments do not serve to the citizens’ interests but to the strategies of anti-Albanian lobbies.

These lobbies have in their service also the representatives of the main potentials of eastern narcotics trafficking that go toward Europe through the corridor Sofia-Belgrade and the islands of Greece. At the disposition for cleaning their money there are hundreds of banks in the south of Peninsula. They cover this activity by presenting the Albanian territory as alarming, while the amount of narcotic substances passing through our country is inexistent, 1.5 tons opposite to 2000-2500 tons that this Eastern route passes in a 12 months period. The amplification of noise for the danger of trafficking in Albania is done for the purposes: A- To cover the network B- To discredit Albanians. C- To elongate the crisis and buy cheaper the resources. D- To weaken and sent toward obliteration our national integrity by means of the domination of the trade market and economy. This play has served to the obstruction of country’s development, ruination of the economical life of citizens, stoppage of production, ruination of the businesses and tourism opportunities, stoppage and destruction of the perspective of hydro-energy, embezzlement of state’s budget, and transfer of money in the hands of foreign bankers. All our economical resources are passing in the hands of non-Albanian capitalists. Apart the low-priced labor force they want to exploit the terrain almost freely, though the Albanian lands are Mediterranean, productive and of the most coveted. With the slogans “Globalization” and “Integration” the Albanian political class has prepared the terrain of this inhuman strategy that serves neither to the United Europe nor to the North Atlantic Allies. Europe would find more useful a developed Albanian nation with its own culture than a degraded people without a motherland, wandering in the streets of Western countries. Keeping the country in a continuous crisis for calling “foreign investments” by “important operators of friendly countries”, is the strategy and the work of this lobbies for easily dominating the market and profiting through politics.

From the information of international representatives we learn that in these activities politicians and state representatives of neighboring countries are also implicated. In police actions of these countries against Albanians, often movements of large amounts of narcotic substances are covered. This worry is raised in front of the western public opinion also by the lawyers of Albanians that are penalized in these countries for inconsiderable amounts of narcotic substances. From the statistics of the western countries it results that not even 10% of Albanians are involved in trafficking. All the others work honestly, want to integrate and are more bound to the family than the citizens of the countries to which they emigrate. Albanian governments not only do not help them, but have signed their return in case they do not have the right of asylum, whilst the majority of the Albanian population is economically based on emigrants’ income. The only opportunity for providing asylum right to an Albanian is when he is afraid to return in Albania because of blood feud. Unfortunately, even the Albanian Police was able to register neither 10% of the conflicts for lands, person’s dignity violation or honor issues, for having the competences to prove the dangerousness of deportation.
The Committee of Nationwide Reconciliation has made efforts to sensitize the western countries that Europe, not only should forbid such behaviors toward Albanian emigrants, but should systemize them in the best possible ways and stop any prejudice toward our people because it has obligations. For the profits of European powers our people was divided in four territories. The economical damage done to our country by this fragmentation would ask as compensation hundred billions of dollars, nevertheless Albanians never raised their voice. In the nowadays conditions it would be an incontestable moral obligation that Europe invested with easing conditions in hydro-energy, education, health system and road infrastructure. In this way it would accelerate the contribution for the acceptance procedures. Of course this investment would have been done if our political class would not be under the influence of regressive politics and would act with dignity for the protection of its people’s interests. The influence of these regressive politics in the Albanian governments has ruined the country and postponed the terms of acceptance in EU. During these 17 years, in the conditions of an extreme poverty, Albanians were able to accumulate 15 billion dollars for their state’s budget, without taking into account the donations of international organizations. This budget was misappropriated with a bulky administrative staff and embezzled for electoral investments without any perspective. Only with 2 billion dollars the hydro-energetic system planned before the transition period would have been completed and it would furnish also other countries of the region, considering the capacity of water sources that it possesses. This system of dams and water-collectors would also be a contribution for tourism and ecology. Nowadays Albanians have opportunities for developing neither tourism nor their economy and capital. The majority of population is unemployed because of the lack of market and country production. Even the trade activity done with scarce merchandises of import has a very low rate and is conducted only during the day hours, while in the neighboring countries only the night activity reaches billions of dollars. In our country, in a very absurd way, the state not only does not stimulate the trade and work during 24 hours but has made illogical laws and rules like the anti-constitutional memorandum of motor boats by impeding the private activity of its citizens.
The strategy of destruction till reaching zero level (a strategy predicted in the beginning of pluralism in the auditors of the political parties) has served to the massive damage of the natural values, eradication of river beds and the cut of forests for selling them in those countries where these values are fanatically protected. Apart the eradication of river beds and almost of all the coastline, TEC-s and AMBO oil pipeline are being build almost for free in the coasts of Adriatic sea, while only for the protection of the ecological system of the environment were they will be installed the contractors should pay a minimal fee of 20 billion dollars. The contracts of investment for these TEC-s and the oil pipeline do not reach even one billion dollars; meanwhile the governments are taking loans from foreign banks even for social issues. Albanian governments declare these loans as their successes by hiding to the people the fact that the obligatory pay off of the dept to these banks will be done with the national resources.

The control of the anti-Albanian lobbies is increasing every day, not only over the economical life but also on the private one. These days the necessary tools were used for the further preservation of the monopoly on the telephone calls of the two foreign companies even though the benefit of these companies on citizen’s expenses is inhuman. The operators from Canada and United States that wanted to intervene for the liberalization of this market confirm that they faced the same obstacles in some countries of Africa, where the companies of the monopoly give tips of more than 10 million dollars to the governors for forbidding new licenses. In a totally inhuman way the state violates the private life for controlling the businesses of the political opponents more than the criminals and the murders that wander freely. The number of persons under eavesdropping in Albania is the same with that in the United States of America, where only in California there is an annual flow of 30 billion dollars from the trafficking of marihuana. Another obvious index of the domination of these lobbies and the benefit on the citizens’ expenses is their monopoly on the casinos and gambling houses. Albanian citizens do not have any protection from this violation and criminal exploitation because the syndicates are inexistent or under political parties’ control. The political battle for taking or having under control the independent institutions of the state has made them powerless against these economical crimes connected with politic. Only simple citizens and their businesses are investigated for economical crime.

In the course of this anti-Albanian politic the attack toward the history and the abandonment till degradation of the values of the national cultural heritage continue for years. With the pretext of reforms, the majority of the scientists with merited titles are left unemployed or pensioned. The obliteration of Sciences Academy is done for eliminating the protection of the values of our national history and heritage, especially of the heritage outside the territory of Albania, which makes up more than 70% of this value. This is a result of the fact that the Albanian political parties do have neither a national mission nor a vision for the values of humanity. The elimination of the political right wing in Albania, which would have in its program the protection of the property and the inherited values, the empowerment of the national economy and the avoidance of the social crises of the country, was the first step of the fulfillment of the strategy of the anti-Albanian lobbies in politic. Their domination continuously emerged also during the electoral processes by inciting uncontrolled funds.

Under the pressure of these lobbies, the exponents of Albanian politic involved in the tragic scenario of the murder of population in 1997 realized the proclamation of an amnesty for covering up this act that carries within even crime against humanity. The Albanian politicians did not accept the least moral responsibility for this crime. The minimum that they should have done, was asking forgiveness to the people and renounce. But they keep recycling themselves in politics and in high positions of the state. On June 21 of 2004, the Committee of Nationwide Reconciliation, in cooperation with some other non-government organizations, presented a memorandum to the Albanian public opinion and international factor for the change of the politico-social situation in Albania and the destruction of the monopoly on the political parties. The memorandum also requested to the highest institutions of Albania state, political parties, prime minister and the chief of the political opposition, the establishment of a national independent commission with experts of state and civil society for the investigation of the connections of crime with politic, examination of the events of 1997 and the revelation of the organizers of the scenario of the civil war and the misappropriation of people’s money as well as putting these persons in front of the justice. The political leadership avoided the establishment of this commission without any explanation. To justify in front of the international pressure that asked the liberalization and democratization of the auditoriums of the political parties, maneuvers in media against some guiltless individuals were done, and “structures composed of civil society members” were established by empowering even more the presence of these lobbies in the Albanian politics.

Favored by the corruption in justices and the laws in the penal code over 2000 criminals, who have became the cause of the blood feud actions on them wander freely in the streets of Albania and Europe (most of these criminals are wanted also by Interpol). During all these years, our requests for a national strategy about the prevention of self-judgment and the observation of the rule of law’s institutions have been abandoned. The consequences have fallen over hundreds of innocent women and children that isolate themselves because they are feared of being murdered for the crime that a relative of their family has committed. The laws favoring the usurpation of other’s property have fostered this tragic aspect of the Albanian society by involving in conflicts more than 200 000 Albanian families. Even though a law for the mediation and establishment of a coordinative council for the prevention of murders for revenge and blood feud was made, no administrative act has been approved for its implementation. By blocking the administrative acts, its avoidance and the compilation of another law, which will be controlled by the Prime Ministry and not the Presidency, were aimed. Unfortunately western donors were captured by the trafficking of influences of the above mention lobbies. Millions of dollars were rewarded for false projects compiled according to the interests of this traffic that do not have any positive effect on Albanian society. The donors have never been vigilant of the operators working with the in Albania. Only for justifying the projects supported by the donors, it has become a custom to propose unnecessary structures and recurrent changes of the laws, without facing them with the reality and human rights, without the juridical logic and professional criteria. This has brought the perception that the law does not belong to citizens’ interests, but to the interests of the political parties, by causing so much “inflation” in its estimation that the citizens do not show more interest on it. For thirteen years projects for the electoral code and for the laws about equal gender were financed and have given no positive result. In the same way, for monetary profits and bad intention unnecessary projects on religious cohabitation are being financed, even if our country is a positive example for the whole world in this direction. The parliamentary resolutions and the draft-laws for the punishment of communism crimes have become political farces and have served nothing to the rehabilitation of the caused damages, especially the ones on the land owners and their persecuted families, religious institutions, clergy and political prisoners.

Considering this situation, the Committee of Nationwide Reconciliation appeals to the European Court of Human Rights, International Criminal Court and to the International Institutions for making the necessary steps to:
1- Establish an international commission for the investigation of the grave violations of human rights and of the crimes on the population in Albania, especially on the events of 1997.
2- Obligate the Albanian State, as responsible for the protection of the pyramidal schemes for returning the money to the citizens and send the guilty persons in front of the justice.
3- Obligate the Albanian State to acknowledge the right of property and compensate the citizens violated by the law 7501 on land issues and the law on legalizations.
4- Obligate the Albanian State to reform the laws that are in opposition with the human rights and International Conventions.
5- Obligate the Albanian State so that the its prosecution and investigation institutions, as well as the Albanian justice to cooperate with the international organizations for the issues pointed out in this document. They can not put justice without the help of the international institutions, because they are under the pressure of the politic and totally unprotected from it. The organizers of the criminal acts on the population during these years are still on the political life and in the state’s administration. The Albanian citizens, who have been victims of politics for 17 years, should feel the responsibility of the international community and justice for the punishment of crimes. The civil war in 1997 was avoided, not because the politicians wanted, but because of the people’s intuition, intervention of the international factor and the work of the representatives of the reconciliation mission in the north that convinced most of the families for not sending their sons in the south against the protestors.

* * * The Committee of Nationwide Reconciliation requests that the political parties should do a fundamental change with dignity in front of the citizens, by establishing a new vision and working with dedication for repairing the damages that they caused to their people.
* * * The Committee of Nationwide Reconciliation appeals to the international factor to protect with human responsibility from ruination the future of our nation, which is one of the oldest trees in the garden of the European cultures. The garden of United Europe will not be more beautiful without the characteristic Albanian tree.
